Terms of Service

Last updated: [DATE]

Welcome to Hyoh. These Terms of Service (“Terms”) govern your use of the Hyoh app and website (the “Service”), operated by [COMPANY / OWNER NAME] (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

1. Who can use Hyoh

You must be at least 13 years old to use Hyoh. If you’re under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian. By using Hyoh, you confirm you meet these requirements and that the information you provide is accurate.

2. Your account

You’re responsible for your account and for keeping your login credentials secure. You’re responsible for activity that happens under your account. If you enable two-factor authentication, keep your recovery method safe. Let us know at hello@hyoh.app if you believe your account has been compromised.

3. What Hyoh does

Hyoh helps you track the national parks you’ve visited, see your progress on a map, earn milestones, and optionally plan trips and share content with the community. Hyoh is for personal, non-commercial enjoyment. It is not a navigation, safety, or emergency tool, and you should not rely on it for those purposes. Always use your own judgment and appropriate resources when traveling or in the outdoors.

4. Free and paid plans

Hyoh offers a free tier and paid subscription plans (“Premium” and “Lifetime”). Paid features and pricing are described in the app.

5. Your content

You may add content to Hyoh, such as photos, captions, notes, and posts (“Your Content”). You keep ownership of Your Content. By posting it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute Your Content solely to operate and provide the Service (for example, showing a photo you post to the community feed to other users).

You are responsible for Your Content and confirm you have the rights to share it. Don’t post content that is illegal, infringing, hateful, harassing, sexually explicit, deceptive, or that violates others’ privacy. We may remove content that violates these Terms.

6. Community conduct

Content you post to community features (like the Explore feed) is visible to other users. Be respectful. Don’t harass others, impersonate anyone, spam, scrape, or attempt to disrupt or gain unauthorized access to the Service. We may suspend or terminate accounts that violate these rules.

7. AI features

Hyoh includes AI-assisted features (such as trip-planning suggestions). AI output can be inaccurate or incomplete, and is provided for convenience only — it is not professional advice. Verify important details (opening hours, closures, conditions, permits, safety) with official sources before you rely on them.

8. Park data

We work hard to keep our park data accurate, but we make no guarantee that all information is complete, current, or error-free. If you spot a problem, please tell us through the in-app report feature.

9. Intellectual property

Hyoh, including its name, logo, design, and software, is owned by us and protected by law. These Terms don’t grant you any right to use our branding without permission. Except for Your Content, you may not copy, modify, distribute, or reverse-engineer the Service.

10. Third-party services

Hyoh relies on third-party services (including Supabase, Stripe, and sign-in providers like Google and Facebook). Your use of those services through Hyoh may also be subject to their terms. We’re not responsible for third-party services.

11. Termination

You can stop using Hyoh and delete your account at any time (see the in-app Delete account option or our data deletion instructions). We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (such as ownership, disclaimers, and limitations of liability) will survive.

12. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the fullest extent permitted by law. We don’t warrant that the Service will be uninterrupted, secure, or error-free.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim (or, if you’re on the free tier, USD $50).

14. Indemnification

You agree to indemnify and hold us harmless from claims arising out of Your Content, your use of the Service, or your violation of these Terms, to the extent permitted by law.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll provide notice (for example, in the app or by updating the date above). Continuing to use the Service after changes take effect means you accept the updated Terms.

16. Governing law & disputes

These Terms are governed by the laws of [STATE/COUNTRY], without regard to conflict-of-laws rules. Any disputes will be resolved in the courts located in [JURISDICTION], unless otherwise required by applicable law. [If you want mandatory arbitration and/or a class-action waiver, have an attorney draft that clause here — it has specific legal requirements.]
